## 1. Reservations and Booking Confirmation

Reservations may be made through our Website, direct booking platform, or authorized third-party booking services.

All reservations are subject to availability, applicable rates, taxes, fees, occupancy limits, and property-specific rules.

A reservation is confirmed only after the required payment has been successfully processed and a booking confirmation has been issued.

Guests are responsible for reviewing all reservation details, including the selected property, dates, occupancy, pricing, and cancellation policy, before completing a booking.

The person making the reservation must be at least 18 years old, have the legal capacity to enter into a binding agreement, and comply with any higher minimum booking age disclosed for the selected property.

The individual making the reservation is responsible for ensuring that all members of their party comply with the applicable reservation terms and property rules.

## 2. Cancellation and Refund Policy

**ALL RESERVATIONS ARE FINAL AND NON-REFUNDABLE UNLESS EXPLICITLY STATED OTHERWISE IN THE APPLICABLE BOOKING TERMS OR RESERVATION CONFIRMATION.**

By completing a reservation, guests acknowledge and agree that:

- Guest-initiated cancellations are not eligible for refunds unless expressly permitted by the applicable booking terms or required by law.

- Changes in travel plans, scheduling conflicts, illness, personal emergencies, or other personal circumstances do not automatically qualify for refunds.

- No refunds or credits will be provided for late arrivals, early departures, no-shows, or unused nights unless otherwise required by law or the applicable reservation agreement.

- Requests to change reservation dates are subject to availability and approval by Modern Escapes.

- Approval of a reservation modification does not automatically create a right to a refund or credit.

- Any discretionary refund, credit, or exception must be expressly approved by Modern Escapes in writing.

- Reservations made through third-party booking platforms are subject to the cancellation and refund terms applicable to those bookings.

If Modern Escapes is unable to provide the reserved accommodation, any refund, alternative accommodation, or other remedy will be determined in accordance with applicable law and the reservation agreement.

Nothing in this policy limits any refund or cancellation rights that cannot legally be waived.

**We strongly encourage guests to purchase travel insurance** to protect against unexpected circumstances, including illness, transportation disruptions, severe weather, and changes in travel plans.

## 3. Pricing, Payments, and Fees

All prices displayed on our Website are subject to availability and may change until a reservation is confirmed.

The total reservation price may include:

- Accommodation charges.

- Cleaning fees.

- Applicable sales, occupancy, and lodging taxes.

- Pet fees, where applicable.

Modern Escapes reserves the right to correct obvious pricing or availability errors, subject to applicable law and any binding reservation agreement.

Additional charges resulting from property damage, violations of rental rules, or optional services will be assessed in accordance with the applicable rental agreement and law.

## 4. Payment Disputes and Chargebacks

Guests agree to review all reservation details and payment terms before completing a booking.

If a guest believes a charge is incorrect, we encourage them to contact Modern Escapes promptly so that we may investigate and attempt to resolve the issue.

Guests remain responsible for legitimate charges authorized under their reservation agreement.

Modern Escapes may provide booking confirmations, payment records, cancellation policy disclosures, guest communications, and other relevant documentation to payment processors or financial institutions when responding to payment disputes.

Nothing in these Terms restricts a guest's lawful right to dispute a charge or exercise protections available under applicable consumer protection laws or payment network rules.

## 5. Check-In and Check-Out

Guests must comply with the check-in and check-out times provided in their reservation confirmation or property instructions.

Early check-in and late check-out requests are subject to availability and must receive prior approval.

Unauthorized early arrivals or late departures may result in additional charges where permitted by the applicable rental agreement and law.

Guests are responsible for following all property access instructions.

Access codes, keys, and other entry credentials must not be shared with unauthorized individuals.

## 6. Occupancy and Guest Responsibilities

Guests must comply with the maximum occupancy limits established for their reserved property.

Only registered guests and visitors expressly permitted under the applicable property rules may access or stay at the accommodation.

The individual making the reservation is responsible for the conduct of their party and for ensuring compliance with property rules.

Guests agree to:

- Treat the property, furnishings, equipment, and amenities with reasonable care.

- Respect neighboring properties and community noise restrictions.

- Follow all posted safety instructions.

- Comply with applicable laws and local regulations.

- Report significant damage, maintenance problems, or safety concerns promptly.

- Avoid conduct that threatens the safety of others or causes substantial damage to the property.

Unauthorized parties, events, excessive noise, smoking, pets, or other prohibited activities may result in additional charges or other remedies as permitted by the applicable rental agreement and law.

## 7. Property Rules and Prohibited Activities

Each Modern Escapes property may have additional rules addressing:

- Maximum occupancy.

- Parties and events.

- Quiet hours.

- Smoking and vaping.

- Pets and service animals.

- Parking.

- Fire pits and outdoor fires.

- Grills and cooking equipment.

- Hot tubs, saunas, and outdoor showers.

- Decks, balconies, and outdoor spaces.

- Trash disposal and property cleanliness.

- Use of recreational amenities.

Guests must review and comply with the rules applicable to their reservation.

Service animals will be accommodated as required by applicable law.

Modern Escapes reserves the right to enforce reasonable property rules consistent with applicable law.

## 8. Property Damage and Additional Cleaning

Guests are responsible for damage caused by themselves or members of their party beyond ordinary wear and tear, to the extent permitted by applicable law and the reservation agreement.

Additional charges may apply for:

- Damage to furnishings, appliances, equipment, or property structures.

- Missing or destroyed property.

- Excessive cleaning beyond normal turnover requirements.

- Unauthorized occupants or pets, subject to applicable law.

- Damage caused by prohibited activities.

- Other documented costs arising from a violation of the reservation agreement.

Modern Escapes will make reasonable efforts to document damage or additional cleaning requirements through photographs, inspection records, invoices, or other supporting evidence.

Guests may be notified of applicable charges and given an opportunity to raise questions or disputes in accordance with the booking agreement and applicable law.

Modern Escapes will not charge guests for ordinary wear and tear.

## 9. Serious Rule Violations and Termination of Stay

Modern Escapes reserves the right to take reasonable action in response to serious violations of property rules or conduct that threatens the safety of guests, neighbors, employees, or the property.

Examples may include:

- Unauthorized large gatherings.

- Dangerous or unlawful activities.

- Significant property damage.

- Threatening or abusive behavior.

- Serious violations of occupancy or safety restrictions.

- Repeated substantial disturbances after reasonable warnings, where appropriate.

Depending on the circumstances, action may include requesting that prohibited conduct stop, contacting appropriate authorities, or terminating the reservation where authorized by the rental agreement and applicable law.

Any removal of occupants will be handled through lawful procedures.

A termination resulting from a guest's material breach does not automatically entitle the guest to a refund, subject to applicable law and the circumstances of the termination.

## 10. Property Availability and Cancellations by Modern Escapes

Modern Escapes makes reasonable efforts to honor all confirmed reservations.

However, circumstances may arise that prevent us from providing a reserved accommodation, including:

- Significant property damage.

- Essential maintenance or repairs.

- Utility failures.

- Safety hazards.

- Government orders or legal restrictions.

- Natural disasters or other events beyond our reasonable control.

If Modern Escapes cannot provide the reserved accommodation, we will notify the guest as promptly as reasonably possible.

Depending on the circumstances, applicable law, and reservation agreement, we may offer an appropriate alternative accommodation, a refund, or another legally required remedy.

Guests will not be required to accept materially different accommodations in place of any remedy to which they are legally entitled.

Nothing in these Terms allows Modern Escapes to retain payments where applicable law requires a refund.

## 11. Amenities, Maintenance, and Property Conditions

We strive to maintain our properties and advertised amenities in good working condition.

However, minor variations may occur in furnishings, décor, landscaping, and equipment.

Amenities may occasionally become unavailable because of maintenance, mechanical failures, weather conditions, safety considerations, or other circumstances.

Guests should promptly report any significant maintenance or amenity issues so that Modern Escapes has a reasonable opportunity to address them.

The temporary unavailability of a minor amenity does not automatically entitle a guest to a refund.

Where an essential advertised amenity is unavailable or a material property issue substantially affects the accommodation, any applicable remedy will be determined under the reservation agreement and applicable law.

## 12. Weather, Travel Disruptions, and Natural Conditions

Some Modern Escapes accommodations are located in rural, mountainous, wooded, or natural environments.

Guests acknowledge that these locations may experience:

- Snow, ice, heavy rain, and severe weather.

- Changing road conditions.

- Wildlife and insects.

- Temporary utility or internet interruptions.

- Seasonal changes in outdoor conditions.

Guests are responsible for making reasonable travel preparations and monitoring weather and road conditions.

Ordinary weather conditions, transportation cancellations, or personal travel disruptions do not automatically entitle guests to refunds under our non-refundable reservation policy.

However, if a property becomes unavailable, unsafe, or legally inaccessible, the situation will be addressed in accordance with applicable law and the reservation agreement.

Nothing in this section limits Modern Escapes' obligation to maintain reasonably safe accommodations.

## 13. Hot Tubs, Saunas, Fire Pits, and Recreational Amenities

Certain Modern Escapes properties feature hot tubs, saunas, fire pits, outdoor showers, elevated decks, recreational equipment, and other amenities.

Guests agree to use these amenities responsibly and comply with posted safety instructions.

Guests must:

- Follow posted operating instructions and safety warnings.

- Supervise children and other individuals requiring assistance.

- Avoid using amenities while impaired by alcohol or drugs.

- Refrain from unsafe or prohibited activities.

- Report malfunctioning or damaged equipment promptly.

- Avoid using equipment that appears unsafe or defective.

Hot tubs, saunas, fire pits, and similar amenities may present risks if used improperly.

Guests are responsible for exercising reasonable care while using these facilities.

Modern Escapes remains responsible for obligations imposed by applicable law, including duties relating to reasonably safe property conditions.

Nothing in these Terms waives liability that cannot legally be waived.

Additional property-specific safety rules may apply.

## 14. Personal Belongings and Security

Guests are responsible for securing their personal belongings during their stay.

Modern Escapes encourages guests to lock doors and windows when leaving the accommodation and to avoid leaving valuables unattended.

Guests should promptly report suspected theft, unauthorized entry, or security concerns.

Modern Escapes is not responsible for losses arising solely from a guest's failure to exercise reasonable care, except to the extent responsibility is imposed by applicable law or arises from our own legally actionable conduct.

Nothing in this section excludes liability that cannot legally be limited.
